AI Transparency Notice

Last Updated: August 2026 | Version: 2026-08-v1

1. Introduction

ImperIQ is an AI-native business platform. Artificial intelligence (AI) is an integral part of our services and supports you in analyzing, creating, and optimizing business processes.

We are committed to full transparency regarding the use of AI in our platform. This notice fulfills the requirements of Regulation (EU) 2024/1689 (EU AI Act), in particular Article 50 (transparency obligations for certain AI systems).

This AI Transparency Notice is a supplementary part of our Terms and Conditions and our Privacy Policy.

2. AI Providers Used

ImperIQ uses AI models from the following providers to deliver its services:

Anthropic (Claude)

  • Location: USA
  • Purpose: Text analysis, content creation, business process support, autonomous support
  • Legal Basis: Art. 6(1)(f) GDPR (legitimate interest)
  • Third Country Transfer: EU Standard Contractual Clauses (Implementing Decision (EU) 2021/914) pursuant to Art. 46(2)(c) GDPR, together with a data processing agreement. Access by US authorities cannot be entirely ruled out (CLOUD Act).

Mistral AI

  • Location: France
  • Purpose: Text analysis, content creation, business process support
  • Legal Basis: Art. 6(1)(f) GDPR (legitimate interest)
  • Third Country Transfer: No third country transfer (processing within the EU)

OpenAI

  • Location: USA
  • Purpose: Text analysis, content creation, business process support
  • Legal Basis: Art. 6(1)(f) GDPR (legitimate interest)
  • Third Country Transfer: EU Standard Contractual Clauses (Implementing Decision (EU) 2021/914) pursuant to Art. 46(2)(c) GDPR, together with a data processing agreement. Access by US authorities cannot be entirely ruled out (CLOUD Act).

fal (Features & Labels, Inc.)

  • Location: USA (San Francisco)
  • Purpose: Image and video generation in the Marketing Studio — only for organizations for which this feature has been separately enabled
  • Legal Basis: Art. 6(1)(b) GDPR (performance of a contract) for the generation you request
  • Third Country Transfer: EU Standard Contractual Clauses (Implementing Decision (EU) 2021/914) pursuant to Art. 46(2)(c) GDPR, together with a data processing agreement. Access by US authorities cannot be entirely ruled out (CLOUD Act).
  • Forwarding to model providers: Some models offered via fal are not operated by fal itself but forwarded to the respective model provider. For the models currently in use, the possible recipients are: Black Forest Labs (Germany/USA), Google LLC (USA), Luma AI, Inc. (USA), and Kling AI Pte. Ltd. (Singapore, Kuaishou group/China). We know which path belongs to which quality tier; not every tier is enabled for every organization. Reference images showing people are technically blocked.

For text and analysis features, the AI model used is selected automatically based on the task requirements and your organization account configuration. In the Marketing Studio, you choose the quality tier yourself.

3. Transparency Levels

ImperIQ labels the degree of AI involvement in content and actions according to three transparency levels. This labelling is displayed visually in the user interface:

Level 1 — AI Suggestion (Cyan)

The AI recommends an action or content. You decide whether to accept the suggestion.

Examples: Wording suggestions, analysis results, action recommendations

Level 2 — AI-Assisted (Violet)

The AI contributed to the creation. You review and edit the result before use.

Examples: Document drafts, prepared reports, summarized data

Level 3 — AI-Automated (Amber)

The AI performs an action independently. You can review and undo the action.

Examples: Automatic categorization, rule-based assignments, scheduled analyses

4. Labelling of AI-Generated Content

All content generated or substantially influenced by AI is labelled in ImperIQ as follows:

  • AI Disclaimer: Every AI-generated content item bears a visible notice stating "This content was generated by AI. Please verify important information." Where available, the AI agent name, generation timestamp, and model used are also displayed.

  • EU AI Act Badge: A compliance badge (shield icon with "EU AI Act") indicates that the AI usage complies with the transparency requirements of the EU AI Act.

  • Color Coding: AI-generated areas of the user interface use a consistent color scheme (cyan for AI content, violet for AI-assisted content, amber for automated actions).

5. Data Processing by AI

5.1 What Is Processed

The AI systems exclusively process data that you enter during platform use or that is necessary to provide the agreed services. This includes:

  • Text inputs into AI-powered features (e.g., analysis queries, drafts)
  • Business data for analysis and preparation (e.g., CRM data, project information)
  • Context data to improve response quality (e.g., organization settings)

5.2 What Does NOT Happen

  • No training on your content: Your inputs are not used to train the language models. This is ensured with each of the providers listed above, either contractually or via the respective account setting. Should we add a further provider in future, we will only list it here after the same review.
  • No Profiling: No automated profiling or scoring of natural persons takes place.
  • No Automated Individual Decisions: No decisions with legal effect or similar significance are made solely by AI (Art. 22 GDPR).
  • No disclosure beyond service delivery: Your data is transmitted solely to the processors listed above and their sub-processors, and only to the extent required to deliver the service you requested. It is not shared for any other purpose.

5.3 Retention and Deletion

AI-processed data is deleted after completion of the respective processing, unless statutory retention obligations apply. Records of AI usage (audit trail) are retained for transparency and accountability purposes.

6. Human Control (Human-in-the-Loop)

ImperIQ implements a multi-level system of human oversight over AI actions:

6.1 Approval System

Certain AI actions require explicit human approval before execution. This applies in particular to:

  • Actions with financial implications
  • Communications with external recipients (email, messages)
  • Changes to compliance-relevant settings
  • Deletion or archiving of data

6.2 Configurability

In your organization settings, you can specify which AI actions require approval and which may be executed automatically. The default setting is restrictive — when in doubt, approval is requested.

6.3 Audit Trail

All AI actions are logged. The audit trail includes:

  • Type of AI action and transparency level
  • Timestamp of execution
  • AI model used
  • Whether human approval was granted
  • Identity of the approver (where applicable)

7. Your Rights

In connection with AI processing, you have the following rights:

  • Right of Access (Art. 15 GDPR): You may request information about which of your data has been processed by AI.
  • Right to Object (Art. 21 GDPR): You may object to AI processing of your data. In this case, the affected features will be available to you without AI support, to the extent technically feasible.
  • Right to Restriction (Art. 18 GDPR): You may request the restriction of AI processing.
  • Right to Lodge a Complaint: You have the right to lodge a complaint with a data protection supervisory authority.

Competent supervisory authority: Der Landesbeauftragte fuer den Datenschutz und die Informationsfreiheit Baden-Wuerttemberg Lautenschlagerstrasse 20, 70173 Stuttgart, Germany

8. Changes to This Notice

We update this AI Transparency Notice when there are material changes to our AI systems or changes in legal requirements. The current version is always available on this page.
